1. INTRODUCTION
1.1 These Terms and Conditions regulate the sale, including registration, of MANNATELIER products, through the website www.mannatelier.com
1.2 The website www.mannatelier.com is managed by the company Maneirarrojada Lda., nº 516808249, Rua Loureiro 4, 1C, 2760-127 Caxias.
1.3 For the purposes of these Terms and Conditions, it is understood as
a) - “MANNATELIER” - Products sold on the website www.mannatelier.com;
b) - "User" - Any natural person, non-merchant, who places an order through the website www.mannatelier.com;
1.4 The use of the website www.mannatelier.com and the purchase of MANNATELIER products presupposes knowledge, understanding and ease of these Terms and Conditions by the User.
2. REGISTER ON THE WEBSITE
2.1 To place an order, the User may register in advance by filling in the fields on the form on the website www.mannatelier.com. It is also possible to place your order without prior registration
2.2 From the moment you access your personal account, the User will find these Terms and Conditions.
3. MANNATELIER PRODUCTS
3.1 The website www.mannatelier.com is aimed at all users who wish to purchase MANNATELIER products, from their home or workplace, 24 hours a day, 7 days a week.
3.2 Information on product characteristics can be found at www.mannatelier.com.
3.3 MANNATELIER reserves the right to modify, at any time, the information, product offerings, prices, promotions and commercial conditions, presentations on the website www.mannatelier.com.
4. PLACING ORDERS ON THE WEBSITE
4.1 To order at www.mannatelier.com, the User must have an email account and their browser must be configured to accept cookies and pop-ups, which will allow them to enjoy all the navigation conditions of the online store MANNATELIER.
4.1.1 The User may purchase products online, for which they must:
a) Find the product(s) you want to purchase;
b) Add the selected product(s) to the "Shopping Cart";
c) Register the User's personal data, which will be integrated into the MANNATELIER database under the terms set out in the Privacy Policy, which include the "Delivery Address", "Billing Address", "Payment Method" , telephone number and tax identification number (TIN);
d) Review your order and confirm the request;
4.2 The User will receive an order confirmation email with details regarding the payment method they selected.
4.3 Your order will be delivered by the logistics operator to the delivery address indicated in the purchase process and with the corresponding detailed invoice.
4.4 By submitting the order form, the User accepts the Terms and Conditions of purchase described at www.manneatelier.com, as well as the Privacy Policy.
4.5 MANNATELIER reserves the right not to accept and cancel orders already confirmed in the following situations:
a) The product is not available;
b) Payment is not made using any of the payment options available on the website www.manneatelier.com;
c) Payment is not confirmed;
d) The billing information is not correct or verifiable;
e) There is an error in the price quote;
f) It is not possible to deliver to the address provided by the User.
5. PRICES
5.1 The prices of products displayed on the website www.mannatelier.com include Added Value (VAT). The total VAT payable by the User will be indicated on the invoice sent to the User.
5.2 Prices are all quoted in euros (€). Please note that changing the country of delivery may have an influence on prices due to different transport costs. Customs costs relating to the country of delivery of the order will be borne by the customer.
5.3 The prices of products presented on the website are subject to change. MANNATELIER reserves the right to change prices without prior notice. The prices displayed at the time of purchase are the prices applied to that purchase.
5.4 If there is an error in the price of the ordered products, MANNATELIER or the User may, until the order is shipped, cancel the order.
5.5 The total price specified at checkout includes taxes from the country of origin (Portugal) and shipping costs.
5.6 The User must only pay the amount specified in the order confirmation.
6. PAYMENT METHODS
6.1 The User may pay for their purchases through payment management entities Paypal and Stripe (credit cards).
6.2 MANNATELIER does not accept any other payment method than those mentioned in the previous point. The User must not attempt to pay by any means other than the specified payment methods. If you do so, we cannot be held responsible for lost payment or any other damages that may arise.
7. SHIPPING COSTS
7.1 Shipping to Portugal costs €5.
7.2 Outside Europe, all orders will have an associated shipping cost, which may require the payment of customs costs, depending on the country of delivery.
8. DELIVERY
8.1 MANNATELIER sends the product(s) ordered by the User, from Monday to Friday, from 9am to 7pm, with the exception of holidays, and on the days and times used by the logistics company, to the delivery address indicated by the User.
8.2 Our delivery service does not include a scheduling option, so the order will be delivered without prior contact from the carrier, and it is necessary to ensure that someone is at the delivery address.
8.3 Delivery times in Portugal vary between 1–2 working days depending on the item ordered. MANNATELIER's ability to respond within the aforementioned deadlines varies depending on stock availability, as well as during promotions, sales and Christmas periods.
8.4 MANNATELIER feels obliged to inform the customer in the event of unavailability of the product(s) ordered, and will refund the amount paid, within a maximum period of 5 days.
8.5 If the carrier is unavailable to deliver the products on the indicated date, the User will be contacted to provide another delivery date.
8.6 Upon delivery, the User must inspect the packaging to check for any damage. If you find that the products are damaged, the User must not accept delivery of the order, which will be returned. The User must report the situation, documented with photographs if possible, via email manneatelier@gmail.com and if agreed, MANNATELIER will resend the order, at no cost to the User. If the User wishes to cancel the order, the entire amount paid will be refunded.
8.7 If you do not receive your order within a maximum period of 20 days from the date of payment for the order, please contact manneatelier@gmail.com. After this period, MANNATELIER cannot be held responsible for the loss of the order.
9. RIGHT TO FREE RESOLUTION
9.1 The User may terminate their contract up to 14 (fourteen) days after receiving the order, provided that:
a) The product(s) have not been used;
b) The product(s) maintain their original characteristics and labels intact;
c) The product(s) are complete. All material accompanying orders must be returned.
9.2 The User can exercise their right to free resolution by sending the Free Resolution model or through any other unequivocal declaration of termination of the contract, to the email manneatelier@gmail.com. You can download the Free Resolution model here.
9.3 The costs of returning the order when exercising the right of free resolution are borne by the customer.
9.4 Once the returned product has been received, MANNATELIER will analyze and confirm the conservation status of the order and, where applicable, will refund within a maximum period of 15 (fifteen) days the amounts paid by the User contained in the order, using the same method used for payment of the order.
9.5 If the returned items show signs of use, MANNATELIER reserves the right not to accept the return and to refuse to refund them.
9.6 The User must note that, if the return was made for reasons other than the justified existence of a defect or non-conformity of the products ordered, MANNATELIER will not reimburse the shipping costs. Therefore, MANNATELIER will not reimburse the costs relating to postage initially borne by the customer for the respective order.
9.7 Please note that these conditions are only valid for orders placed in Portugal. If your order was placed outside Portugal, please contact us via email at manneatelier@gmail.com.
10. CANCELLATIONS AND RETURNS
10.1 The User may cancel their order, as long as they request it via email manneatelier@gmail.com before it is sent.
10.2 If the order has been received before shipping, we will reimburse the amounts paid by the User included in the order, through the same means used to pay for the order, within a maximum period of 15 (fifteen) days.
10.3 If the request has been received after sending, the rules contained in the previous chapter, relating to the right of free resolution, will apply.
10.4 MANNATELIER does not offer direct exchanges. The User may opt for a voucher to exchange their order for another item available on the website, being responsible for all costs related to new shipping. Please note that orders placed with a voucher and subsequently returned will only be able to receive a new voucher as a refund and have a validity period of 12 months.
10.5 If the ordered product is defective or otherwise non-conforming, the User may choose to:
a) replace the product;
b) terminate the contract.
10.6 As soon as the User notices a defect or other non-conformity in the product, they must notify us via email at manneatelier@gmail.com, sending supporting photographs.
10.7 As soon as we receive your email, we will contact you to resolve the problem consensually.
10.8 In any of the options exercised by the User, pursuant to 10.6, the respective costs will always be borne by MANNATELIER.
11. QUALITY
MANNATELIER does not sell second-hand products, which are defective or of lower quality than those currently available on the market. The main features of each product shown on www.mannatelier.com can be found on each product page.
MANNATELIER will make every effort to ensure that the colors of the products that appear on the website www.mannatelier.com are as accurate and real as possible. However, as computer monitors vary, we cannot guarantee that your monitor is showing accurate colors.
12. COMPLAINTS
In view of the objective of continuous improvement of the services provided, MANNATELIER will seek to respond to and resolve complaints presented by the User within 5 (five) business days, via email manneatelier@gmail.com.
13. WARRANTY AND AFTER SALES SERVICES
MANNATELIER products benefit from the guarantee of conformity provided for in the legislation applicable to the sale of consumer goods.
14. EXCLUSION AND LIMITATION OF LIABILITY
MANNATELIER does not guarantee the uninterrupted operation of the website www.manneatelier.com, or any of its functionalities, and it may be suspended to carry out maintenance, repair or update actions.
MANNATELIER will also not assume any responsibility for any damages arising, directly or indirectly, from situations of force majeure that prevent MANNATELIER, in any way whatsoever, from fulfilling its obligations, namely strikes, network failures electricity, telecommunications services or any other services, fires, floods, impossibility of obtaining products, materials or services, breakdowns, delays by suppliers or transporters and changes in legislation or administrative regulations.
MANNATELIER is not responsible for any abusive use of the User's access data to the website by third parties, as they are personal and non-transferable.
15. MODIFICATION OF TERMS AND CONDITIONS
MANNATELIER reserves the right to change these Terms and Conditions at any time, considering the changes made and users notified by publishing the modified Terms and Conditions on the website www.mannatelier.com.
16. PROCESSING OF PERSONAL DATA
We ask that you carefully read our Privacy Policy so that you can become aware of the rules and procedures adopted by MANNATELIER regarding the processing of data collected when you browse the website www.mannatelier.com and when you use the functionalities it offers, as well as the applicable security and confidentiality measures.
17. PROOF AND FILE
Computer records, maintained by MANNATELIER under secure conditions, are considered as proof of communications, orders and payments made between Manne Atelier and the User.
18. APPLICABLE LAW
These Terms and Conditions and all emerging disputes related to them, including their validity, the use of the website or any purchase on it must be governed by Portuguese Law.
